Check in and check out

Check in time is 3:00 pm.  Check out time is 11:00 AM.  Guests arriving at the check-in center prior to the 4:00 PM check-in time are not likely to secure an early check-in.  If you plan to arrive after regular business hours, we will make special arrangements for you to secure your keys. Unlike small, cramped hotel rooms, it takes a full day to professional clean and sanitize a rental home.  So an early check in can only occur if the home was empty the night before.  A late check- out, early check- in and a late check- in are only possible by paying an extra $100.00 an hour and must be arranged in advance.  Guests who fail to return their keys or leave their rental property on time will incur a $100 charge an hour or an extra day charge.

Security Deposit

Security deposit is for damages and excess cleaning and is $1000.00 but may exceed $1000.00 due to damages caused during the time of your stay. The security deposit is refunded no later than 25 days after check. You have paid for light cleaning but if the house requires heavy cleaning, you will be charged extra. Heavy cleaning is for example, when vacuuming the carpet is not good enough and it needs a professional cleaned due to spills etc. or the Jacuzzi has any sand in it is half full and has UFO’s (unknown floating objects) and requires a full service or linens are soiled beyond washing and need to be replaced or any appliance is broken beyond normal wear and tear. Please note that there are no refunds for cancellations. No parties/ gatherings or excessive noise allowed or you will forfeit your security deposit. Reservation and Payment Terms

A $1000.00 non-refundable deposit is due immediately upon making your reservation.  The balance of your account is due 30 days prior to your scheduled arrival.  Late payment could result in the cancellation of your reservation and loss of your deposit.

Confidential Information

Each party will keep secret all information made available by the other party, including the contents of this agreement, business practices of either party and details of each reservation. All the renters will not speak or answer any questions about their stay at the house, including neighbors, maids, etc.

Cancellation Policy

If you cancel your reservation more than 30 days prior to your scheduled arrival, you forfeit your deposit, but will not be charged the balance of your account.  We regret we are unable to refund trips paid in full within 30 days of your scheduled arrival for any reason.  Therefore we highly recommend guests purchase travel insurance (see below). The homeowner can cancel the reservation for any good reason. If the renter gives the wrong information about what is going to go on in the home while the renter is occupying or the number of people that will be occupying the property. If the reservation is misleading in anyway by the renter, the homeowner will cancel the reservation and keep whatever was already paid by the renter.

Travel Insurance

Because vacations can be disrupted for a variety of reasons including (but not limited to) emergencies, death, airline delays & disruptions, illness and bad weather we highly recommend you purchase travel insurance at the time of your reservation.  Insurance can usually be secured from an independent agency at 6%-7% of your total reservation

Your Rental Home/Special Requests

If you made a special request when reserving your home, it is understood that, while we will do everything possible to fulfill your request, we cannot guarantee that your special request will be met.

Minimum Stay

Minimum stay for this exquisite home is 3 nights. We can not have less than that for a regular quite stay. We will do some special events here where people will be spending 1 night here but the rates will be completely custom per event. Starting $3,000-15,000 a day.

Occupancy

There will be maximum of 50 people for any event and maximum 10 people for overnight stay. By state law, occupancy may not exceed what is posted for each home (Generally 2 people per bedroom plus 2 additional people on the sleeper sofas.) Maximum occupancy excludes children under three years of age.

Smoking

No smoking is permitted in the property.

Pets

No pets will be permitted on the property.

pool Area

Children should not be allowed to swim unattended.  No running, diving, or horseplay in the pool area.  Please bring your own beach towels.  Do not bring glass into the pool area. According to Chapter 515.33 of the Residential Swimming Pool Safety Act: Anyone tampering with or disconnecting pool alarms commits a misdemeanor of the second degree, punishable by a $5000 fine or one (1) year in jail.   Please do not tamper with the pool alarms.

Pool heat is extra and will be charged if used (the rate is $99.00 a day)

Limitation of Liability

If you are unhappy with your vacation home for any reason, please contact us immediately and we will make every effort to remedy the problem.  Our first priority will be to fix any problems in your current home.    Choosing to remain at a property signifies your satisfaction with it and thus we are unable to offer any discounts or refunds after the fact.  Telling us about a problem at departure time will help us to fix the problem for the next guest—But we want a chance to remedy the problem for you!

Waiver:

In consideration of being permitted to participate in activities (hereinafter called “The Activity) associated with the rental of vacation rental from I-Jam Services Inc, including but not limited such actions as riding bikes, swimming in pool, playing tennis, cooking, barbequing and other uses of this property for I, myself, my heirs, personal representatives, friends or assigns and fellow guests and renters, do hereby release, waive, discharge, and covenant not to sue the owners of properties represented by I-Jam Services Inc, and owners and employees of I-Jam Services Inc. from any and all claims including negligence resulting in personal injury, accidents or illnesses (including death), and property loss arising from, but not limited to “The Activity”.

Assumption of Risk:

Participation in “The Activity” (riding bikes, Jacuzzi, pool…) carries with it certain inherent risks that cannot be eliminated regardless of care taken to avoid injuries. The specific risks vary from one activity to another but risks range from minor injuries such as scratches, bruises, and sprains; major injuries such as eye injury, joint or back injuries, hear attacks and concussions to catastrophic injuries including paralysis and death.

I have read the previous paragraphs and I know, understand, and appreciate these and other risks that are inherent in the Activity. I hereby assert that my participation is voluntary and that I knowingly assume all such risks.

Indemnification and Hold Harmless: I also agree to INDEMNIFY AND HOLD the I-Jam Services Inc., its members and clients HARMLESS from any and all claims, actions, suites, procedures, costs, expenses, damages, and liabilities, including attorney’s fees brought as a result of my involvement in The Activity and to reimburse them for any such expenses incurred.

Severability:

  The undersigned further expressly agrees that the foregoing waiver and assumption of risks agreement is intended to be as broad and inclusive as is permitted by law of the state of California and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

Acknowledgment of Understanding:

 I have read this waiver of liability, assumption of risk, and indemnity agreement, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement free and voluntarily, and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
